1. Acceptance of Terms

By accessing or using kwack.io ("the Service"), operated by kwack ("we", "our", "us"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

kwack is a study platform for medical students that provides OSCE practice cases, multiple-choice questions, flashcards, spaced repetition review, and AI-powered content generation. The Service may also integrate with third-party platforms such as Notion for content import.

3. Accounts

You must create an account to use kwack. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to update it as needed.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is offensive, defamatory, or infringes on the rights of others
  • Attempt to gain unauthorised access to the Service or its systems
  • Use the Service to distribute spam or malicious content
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Scrape, crawl, or use automated tools to extract data from the Service without permission

5. User-Generated Content

You may create and share study content on kwack, including OSCE cases, flashcard decks, and question sets. You retain ownership of content you create. By publishing content on kwack, you grant us a non-exclusive, royalty-free licence to display and distribute that content to other users of the platform.

You are responsible for ensuring that content you create or import does not infringe on any third-party intellectual property rights.

6. AI-Generated Content

kwack uses artificial intelligence (via OpenAI) to generate flashcards, MCQs, and provide voice practice feedback. AI-generated content is provided for educational purposes only and may contain errors or inaccuracies. You should always verify AI-generated medical content against authoritative sources.

We do not guarantee the accuracy, completeness, or clinical appropriateness of any AI-generated content. kwack is a study aid and is not a substitute for professional medical education, training, or clinical judgement.

7. Third-Party Integrations

The Service may allow you to connect third-party accounts such as Notion. When you connect a third-party service, you authorise us to access the content you select for import. Your use of third-party services is governed by their respective terms of service. We are not responsible for the availability or content of third-party services.

You may disconnect third-party integrations at any time from your Settings page.

8. Intellectual Property

The Service, including its design, features, and original content, is owned by kwack and is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

kwack is not a medical device and is not intended to provide medical advice, diagnosis, or treatment. All medical content on the platform is for educational and study purposes only.

10. Limitation of Liability

To the maximum extent permitted by law, kwack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to reliance on AI-generated content.

11. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Use. You may delete your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

12. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by posting a notice on our website. Your continued use of kwack after changes are posted constitutes acceptance of the updated terms.

13. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Australia.
